MOTION
Upon recommendation of Navid Mehram, Chief Operating Officer - Wastewater Operating Services, the Board of Directors (Board) of the Great Lakes Water Authority (GLWA), authorizes the Chief Executive Officer (CEO) to amend the existing Contract No.1803776, “Relocation of the Analytical Lab Operations to the GLWA-WRRF”, with Commercial Contracting Corporation, by extending the contract substantial completion date of the expanded lab/office area by 83 calendar days, substantial completion date of the asset area work by 114 calendar days, final completion date of the project by 83 calendar days, making the total revised contract duration 630 days, and increasing the Contract value by $250,000.00, making the total Contract amount of not to exceed $11,749,000.00 and authorizes the CEO to take such other action as may be necessary to accomplish the intent of this vote.
BACKGROUND
On September 09, 2019, the Great Lakes Water Authority awarded the GLWA Contract 1803776 (Relocation of the Analytical Lab Operations to the GLWA-WRRF), to Commercial Contracting Corporation (CCC). The required substantial completion date of the project was September 08, 2020 and the required final completion date is March 08, 2021 with a contract amount of $11,499,000.00.
The scope of work includes renovation/reconfiguration of the current WRRF laboratory, roof replacement and HVAC controls upgrade of the Administration Building, and renovation of the current local asset group area adjacent to the laboratory. The project is intended to accommodate the relocation of the 2nd Avenue Analytical Lab, its current location, to the 2nd floor of the Administration Building at the WRRF.
As of August 31, 2020, approximately 85% of the contract work is complete. However, almost 100% of the substantial completion and 65% of the final completion time has elapsed.
JUSTIFICATION
Time Extension for the Expanded Lab/Office Substantial Completion:
The original contract substantial completion date is September 8, 2020. This date is not expected to be met due to delays encountered during the construction of the work. The contractor has requested extension of the substantial completion date of the expanded lab/office area to November 30, 2020 via their letter dated August 5, 2020. The contractor indicated that the project has experienced supply chain and personnel issues since the start of the COVID-19 pandemic. Supply chain issues include the following:
• Drywall supply
• Piping supply - piping supplier was having difficulty delivering material to site. Some 2nd tier suppliers did not feel comfortable delivering to the WRRF during the pandemic.
• Doors, frames, and hardware - suppliers closed fabrication shops from March through May 2020.
• Walk-in refrigerators - production lead time increased due to the pandemic.
• Cart lift - The lift production lead time was delayed due to the pandemic.
• Countertop - Supplier could not find qualified people to work on the countertops during the pandemic
In addition, CCC and their subcontractors have experienced shortage of carpenters, electricians, and roofers during this pandemic.
In consideration to the above, a time extension of 83 calendar days is recommended and requested in this proposed change order at no cost to GLWA for this time extension. The proposed substantial completion date of the expanded lab/office area is November 30, 2020.
Time Extension for the Substantial Completion of the Asset Group Area Only:
The Contract scope of the Asset Group area, which is part of the Contract, was revised to incorporate the Wastewater Master Plan functional area optimization recommendations. Work was suspended on October 21, 2019 and it resumed in mid-August 2020 after revised construction drawings were completed and made available to the Contractor. The GLWA negotiated with the contractor 31 additional days’ time extension beyond the revised substantial completion date of the expanded lab/office area noted above. This equates to a total time extension of 114 days moving the substantial completion date of December 31, 2020.
Time Extension for the Contract Final Completion
The original final completion date of the contract is March 8, 2021. A time extension of 83 calendar days is hereby requested making the revised final completion date May 30, 2021. This “administrative” time extension will allow for final payment to be processed, contract close out documentation (as-builts) to be submitted, reviewed, and approved.

Additional Funds to the Contract Provisional Allowance:
The Contract provisional allowance of $1,000,000.00 has been mostly exhausted (only $17,033.00 is remaining). The schedule of expenses accrued through the provisional allowance are enclosed with this letter.
Additional changes are still expected. Listed below are some of the probable changes:
• Install surge suppressors on the distribution and heat trace electrical panels in the penthouse- NAB.
• Revise/reinforce the Laboratories shelving to accept the UPS equipment.
• Doors and hardware changes, including electric actuators.
• Revisions to ductwork in the GCMS fume hood and asset group area.
• Change the terrazzo in the ramped hallway connecting the new and old administration building to non-slip rubber flooring.
• Potential laboratory changes already discussed with lab management such as additional utility outlets, equipment etc.
• Furnish and install Jockey pump and a drain valve on the fire sprinkler pipe in basement of the new administration building.
• General Conditions cost increase for the asset area.
Therefore, in consideration of the probable changes listed above and other unforeseen conditions, an additional amount of $250,000.00 is hereby requested in this Change Order to be added to the existing allowance amount. This will allow GLWA to work with the contractor on the expected additional work in a timely manner. Any unused funds will be credited back to GLWA via the final Change Order.
