RE:                     Proposed Amendment No. 2 to Legal Services Contract LS-2102207 (Schenk and Bruetsch, PLC)

                     

MOTION

 

Upon recommendation and opinion of Phyllis Hurks, General Counsel, the Board of Directors (Board) for the Great Lakes Water Authority (GLWA):(1) approves Amendment No. 2 to Legal Services Contract LS-2102207 with Schenk and Bruetsch, PLC, for no additional Dollars and a term ending May 31, 2028; and (2) authorizes the Chief Executive Officer to take such other action as may be necessary to accomplish the intent of this vote, including the execution of Amendment No. 2 to Legal Services Contract LS-2102207 with Schenk and Bruetsch, PLC.

 

JUSTIFICATION

 

GLWA retained Schenk and Bruetsch, PLC as Legal Counsel for GLWA in the June 25th and 26th Rain Event Matter. The litigation continues and keeping the continuity of the legal team handling the matter is in the best interest of GLWA. This legal matter has taken longer than most, but there were delays in the case due to the pandemic and the complexity of the litigation.  This amendment would extend the time through May 31, 2028. Due to the contract exceeding five years, Board approval is required. 

BUDGET IMPACT

 

There are sufficient funds allocated in the General Counsel’s budget for the continuation of Schenk and Bruetsch, PLC’s services.

This matter is being presented to the Legal Committee at its meeting on May 27, 2026.

 

SHARED SERVICES IMPACT

 

This request does not impact the Shared Services Agreement between GLWA and DWSD.
