MOTION
Upon recommendation and opinion of David W. Jones, General Counsel, the Board of Directors (Board) for the Great Lakes Water Authority (GLWA): (1) approves Amendment No. 2 to Consultant Services Contract CS-2102200 with Wade Trim Associates, Inc; and (2) authorizes the Chief Executive Officer to take such other action as may be necessary to accomplish the intent of this vote, including the execution of Amendment No. 2 to Consultant Services Contract CS-2102200 with Wade Trim Associates, Inc.
JUSTIFICATION
Ratification of this amendment is being requested because it was inadvertently executed on September 4, 2024, without the Board's approval.
GLWA retained Wade Trim Associates, Inc., as Expert Witnesses for GLWA in the June 25th and 26th Rain Event Matter. The litigation continues and keeping the continuity of the legal team handling the matter is in the best interest of GLWA. This legal matter has taken longer than most but there were delays in the case due to the pandemic and the complexity of the litigation. This contract expires on May 31, 2024, and GLWA would like to exercise its renewal option. Due to the amount of the contract, Board approval is required.
BUDGET IMPACT
There are sufficient funds allocated in the General Counsel's budget for the continuation of Wade Trim Associates, Inc's. services.
