RE: Approval of the Industrial Pretreatment Program Rules 2024 Amendment
MOTION
Upon recommendation of David W. Jones, General Counsel, the Board of Directors ("Board") for the Great Lakes Water Authority ("GLWA"): approves the Updated 2024 GLWA Industrial Pretreatment Program Rules, as amended; and authorizes the Chief Executive Officer to take such other action as may be necessary to accomplish the intent of this vote.
JUSTIFICATION
The Industrial Pretreatment Program ("IPP") is administered for the enforcement of local pollution controls following the objectives of the National Pollutant Discharge Elimination System (NPDES) permit and the Clean Water Act ("CWA"). The Michigan Department of Environment, Great Lakes and Energy ("EGLE") is currently negotiating GLWA/Detroit Water and Sewerage Department's ("DWSD") NPDES permit, and the IPP Rules have been updated to incorporate relevant changes.
On July 1, 2019, EGLE issued GLWA/DWSD's current NPDES Permit, which required GLWA to (i) develop GLWA IPP Rules, (ii) develop and obtain approval from EGLE for a revised IPP based upon the aforementioned GLWA Rules, and (iii) amend the GLWA Rules to incorporate the Local Limits Evaluation report of June 1, 2021, as revised. The Updated 2024 IPP Rules address these requirements.
The current Industrial Waste Control regulatory programs include: (1) the IPP, (2) the Surcharge Program, (3) the Hauled-in-Waste Program, and (4) the Special Waste Discharge Program.
