MOTION

 

Upon recommendation and opinion of Suzanne R. Coffey, Chief Executive Officer, and David W. Jones, General Counsel, the Board of Directors for the Great Lakes Water Authority (GLWA), moves for the following:

 

(1)                     approval and execution of a Permanent Easement Agreement between GLWA and Great Lakes Petroleum Terminal, LLC, property owner of the property located at 12500 Stocker Street, Detroit, Michigan 48217; and

 

(2)                     authorizes the Chief Executive Officer to take such other action as may be necessary to accomplish the intent of this vote. 

 

 

 

 

JUSTIFICATION

GLWA must acquire this permanent easement because GLWA needs access to this property for the Northwest Interceptor to Oakwood CSO Sewer project. Without this Permanent Easement Agreement, GLWA cannot move forward with the project.

 

BUDGET IMPACT

Property acquisitions were included in the Northwest Interceptor to Oakwood CSO Sewer project budget.

COMMITTEE REVIEW

This matter was presented to the Legal Committee at its meeting on October 23, 2024. The Legal Committee unanimously recommended that the GLWA Board adopt the resolution as presented.

SHARED SERVICES IMPACT

This request does not impact the Shared Services Agreement between GLWA and DWSD.
