MOTION

 

Upon recommendation and opinion of David W. Jones, General Counsel, the Board of Directors (Board) for the Great Lakes Water Authority (GLWA): (1) recommends the approval of an Easement Agreement between GLWA and Utica Community Schools, Property Owner of 2400 Belle View Drive, Shelby Township, Michigan 48316-2900 (Tax Parcel No. 23-07-18-151-006); and (2) authorizes the Chief Executive Officer to take such other action as may be necessary to accomplish the intent of this vote, including the execution of an Easement Agreement. 

 

 

 

JUSTIFICATION

GLWA needs to acquire a temporary easement over property owned by Utica Community Schools. The easement is needed in conjunction with the 96-inch water main relocation project. Without an easement agreement, GLWA cannot move forward with the project in the most cost-effective manner.

 

BUDGET IMPACT

Easement acquisitions were included in the budget for the 96-inch relocation project.

COMMITTEE REVIEW

This matter was presented to the Legal Committee at its meeting on May 22, 2024. The Legal Committee recommended that the GLWA Board adopt the resolution as presented.

SHARED SERVICES IMPACT

This request does not impact the Shared Services Agreement.
