RE:                     Proposed Amendment No. 1 to Reciprocal Backup Water Service Contract with Genesee County Drain Commissioner

 

MOTION

 

Upon recommendation of Randal Brown, General Counsel, the Board of Directors (“Board”) of the Great Lakes Water Authority (“GLWA”), authorizes the Chief Executive Officer (“CEO”) to execute Amendment No. 1 (“Amendment”) to the 30-year reciprocal backup water service contract (“Contract”) with the Genesee County Drain Commissioner; and authorizes the CEO to take such other action as may be necessary to accomplish the intent of this vote.

BACKGROUND

On 12/13/2022, the Genesee County Drain Commissioner (“GCDC”) agreed to the terms of the Amendment to its Contract with GLWA. This Amendment is necessary to modify Exhibit E, “GCDC Reciprocal Backup Water Rates”, which is updated to include the monthly fixed fee and commodity charges for calendar years 2023 through 2028.

 

JUSTIFICATION

Approval of this Amendment provides a mutually beneficial, stable, long-term framework for interactions between GLWA and GCDC and ensures reciprocal backup water services between the GCDC and GLWA service areas in the event of an emergency.

 

 

 

 

BUDGET IMPACT

The budgetary impacts resulting from this Amendment, or the occurrence of the services contemplated by the Contract, will be reflected in the fiscal year in which the service event occurs between GCDC and GLWA.

COMMITTEE REVIEW

This matter is being presented to the Legal Committee for consideration at its meeting on January 25, 2023.  The Legal Committee unanimously recommended that the GLWA Board adopt the resolution as presented.

SHARED SERVICES IMPACT

This item does not impact the shared services agreement between GLWA and DWSD.
