MOTION

Upon recommendation and opinion Randal M. Brown, General Counsel, the Board of Directors (Board) for the Great Lakes Water Authority (GLWA):

(1) Approves an access agreement with Avanath North End Parcel Owner I, LLC across various parcels in the North End in Detroit, MI; and

(2) Authorizes the Chief Executive Officer to take such other action as may be necessary to accomplish the intent of this vote, including the execution of the Access Agreement and related documents.




JUSTIFICATION
To rehabilitate the Woodward Sewer, GLWA needs land for staging equipment, materials and soil along the route of the Woodward Sewer. Working with GLWA's consultant on this project, GLWA has identified properties that it needs access to adjacent to the Woodward Sewer. Multiple properties near the Sewer are owned by or under and purchase and development with Avanath North End Parcel Owner I, LLC in the North End. GLWA negotiated an access agreement with the property developer. GLWA has the option of paying a one-time fee of $6,000 or $1,200 per parcel accessed. Additional easements are necessary to support the rehabilitation of the Sewer and will be presented to the Board as they are negotiated with the property owners.

BUDGET IMPACT
There are sufficient funds allocated for the access agreement in the CIP.
