MOTION

Upon recommendation of Navid Mehram, Chief Operating Officer - Wastewater Operating Services, the Board of Directors (Board) of the Great Lakes Water Authority (GLWA), authorizes the Interim Chief Executive Officer (ICEO) to enter into Contract No. GLWA-CS-060, Proposed Change Order No. 3, “Study/Design of an Upgraded Sludge Conveyance System and Lighting Improvements at the Detroit Wastewater Treatment Plant” with Black & Veatch Limited of Michigan, with no increase in cost, for a total cost not to exceed $2,086,404.00 and an increased duration of 365 days for a total contract duration of 2,619 days; and authorizes the ICEO to take such other action as may be necessary to accomplish the intent of this vote. 

 

BACKGROUND

Black & Veatch Limited of Michigan was awarded the original contract with a start work date of April 29, 2016, for a total contract amount of not-to-exceed $1,990,000.00 for a duration of 914 days. The main objective of the Black & Veatch consultant services contract was to restore sludge conveyance capacity lost due to the March 2016 fire damage while providing improved sludge conveyance from each dewatering facility to improve operations and minimize future risks. To achieve that goal, evaluation study and design and construction assistance was needed.

On April 14, 2018, Black & Veatch was granted a contract Change Order No. 1 of $96,404.00 for additional design and construction assistance activities, which increased the total contract value to $2,086,404.00.  The contract duration also was extended via Change Order No.1 to a final completion date of June 29, 2021.

On May 26, 2021, Black & Veatch was granted a contract Change Order No. 2 to extend the contract time from June 30, 2021, to June 30, 2022.  The total contract value remained at $2,086,404.00. 

JUSTIFICATION

Construction Change Order No. 2 was issued on January 26, 2022, to Weiss Construction Company for the associated construction contract (GLWA-CON-197) extending the construction contract times to July 31, 2022, for Substantial Completion and January 31, 2023, for Final Completion. It is anticipated that GLWA-CON-197 may not achieve final completion by January 31, 2023, because of performance issues associated with some of the new equipment and other issues.

Black & Veatch and GLWA Construction Engineering agree that an extension of 365 days is needed for the current contract time under CS-060.  The final completion date of June 30, 2023 will allow for Black & Veatch to complete the remaining contractual construction administration services to GLWA.  Black & Veatch has requested $15,719.00 associated with this time extension. The additional cost requested will be reviewed/negotiated and paid for with the remaining balance in the CS-060 provisionary allowance. The original provisionary allowance included in the contract is $240,000.00.  The current available balance by design change directive as of April 30, 2022, is $84,097.00.  The cost associated with this time extension will be paid from the available provisionary allowance balance.
