MOTION

 

Upon recommendation and opinion of Randal M. Brown, General Counsel, the Board of Directors (Board) for the Great Lakes Water Authority (GLWA) recommends the (1) approval of an Easement Agreement between GLWA and Tenerty Properties, L.C. and (2) authorization for the Chief Executive Officer to take such other action as may be necessary to accomplish the intent of this vote, including the execution of an Easement Agreement. 

 

JUSTIFICATION

GLWA needs to acquire a permanent easement over property owned by Tenerty Properties L.C. and located at 24120 Hagerty Road.  The easement is needed in conjunction with the 14 Mile Road Loop Project. Without an easement agreement, GLWA’s ability to construct the 14 Mile Road Loop Project will be compromised.

 

 

 

BUDGET IMPACT

Easement acquisitions were included in the budget for the 14 Mile Road Loop Project.

COMMITTEE REVIEW

This matter was presented to the Legal Committee on May 26, 2021.  The Legal Committee unanimously recommended that the GLWA Board adopt the resolution as presented.

SHARED SERVICES IMPACT

This request does not impact the Shared Services Agreement.
