MOTION

 

Upon recommendation and opinion of Randal M. Brown, General Counsel, the Board of Directors (Board) for the Great Lakes Water Authority (GLWA) recommends the (1) approval of an Easement Agreement between GLWA and Walsh College of Accountancy and Business Administration and (2) authorization for the Chief Executive Officer to take such other action as may be necessary to accomplish the intent of this vote, including the execution of an Easement Agreement. 

 

JUSTIFICATION

GLWA needs to acquire three water pipeline easements over property owned by Walsh College of Accountancy and Business Administration and located at 41500 Gardenbrook Road.  The easements are needed in conjunction with the 14 Mile Road Loop Project. Without an easement agreement, GLWA’s ability to construct the 14 Mile Road Loop Project will be compromised.

 

BUDGET IMPACT

Easement acquisitions were included in the budget for the 14 Mile Road Loop Project.

COMMITTEE REVIEW

This matter was presented to the Legal Committee on November 25, 2020.  The Legal Committee unanimously recommended that the GLWA Board adopt the resolution as presented.

SHARED SERVICES IMPACT

This request does not impact the Shared Services Agreement.
