RE: Easement Agreement between GLWA and 39050 Grand River, LLC
MOTION
Upon recommendation and opinion of Randal M. Brown, General Counsel, the Board of Directors (Board) for the Great Lakes Water Authority (GLWA) (1) approves an Easement Agreement between GLWA and 39050 Grand River, LLC; and (2) authorization for the Chief Executive Officer to take such other action as may be necessary to accomplish the intent of this vote, including the execution of an Easement Agreement.
JUSTIFICATION
GLWA needs to acquire three water pipeline easements over property owned by 39050 Grand River, LLC and located at 39050 Grand River Avenue. The easements are needed in conjunction with the 14 Mile Road Loop Project. Without an easement agreement, GLWA’s ability to construct the 14 Mile Road Loop Project will be compromised.
BUDGET IMPACT
Easement acquisitions were included in the budget for the 14 Mile Road Loop Project.
COMMITTEE REVIEW
This matter was presented to the Legal Committee at its October 28, 2020 meeting. The Legal Committee unanimously recommended that the GLWA Board adopt the resolution as presented.
SHARED SERVICES IMPACT
This request does not impact the Shared Services Agreement.
