MOTION

 

Upon recommendation and opinion of Randal M. Brown, General Counsel, the Board of Directors (Board) for the Great Lakes Water Authority (GLWA):  (1) approves an Easement Agreement between GLWA and the Arie Farmington, LLC; and (2) authorizes the Chief Executive Officer to take such other action as may be necessary to accomplish the intent of this vote, including the execution of an Easement Agreement. 

 

JUSTIFICATION

GLWA needs to acquire an access easement over property owned by Arie Farmington, LLC and located at 24000 Haggerty Road.  The access easement is needed in conjunction with the 14 Mile Road Loop Project, so that GLWA can access its facilities being constructed in the I-275 corridor from Haggerty Road. Without this easement agreement, GLWA’s ability to construct the 14 Mile Road Loop Project will be compromised.

 

BUDGET IMPACT

Easement acquisitions were included in the budget for the 14 Mile Road Loop Project.

COMMITTEE REVIEW

This matter was presented to the Legal Committee at its July 22, 2020 Meeting.  The Legal Committee unanimously recommended that the GLWA Board adopt the resolution as presented.

This request does not impact the Shared Services Agreement.
