MOTION

Upon recommendation of Navid Mehram, Chief Operating Officer - Wastewater, the Board of Directors (Board) of the Great Lakes Water Authority (GLWA), authorizes the Chief Executive Officer (CEO) to enter into Contract No. PC-796 Change Order 2, “Aeration System Improvements” with Weiss Construction Company, LLC, at a cost not to exceed $15,835,000.00 for an increased duration of 90 days for a total contract length of 990 days; and authorizes the CEO to take such other action as may be necessary to accomplish the intent of this vote. 

 

 

BACKGROUND

On October 3, 2016, Great Lakes Water Authority awarded this contract to rehabilitate and upgrade the Water Resource Recovery Facility (WRRF) aeration system to Weiss Construction Company, LLC. The scope of work includes the replacement of process piping, magnetic flow meters, valves, sluice gates and actuators, and variable frequency drives (VFD), as well as miscellaneous architectural, structural, HVAC, electrical and instrumentation controls components.

 

The original contract length was 720 days with required substantial and final completion dates of July 25, 2018 and September 24, 2018, respectively. Through Change Order No.1 the contract length was increased by 180 days revising the substantial and final completion dates to January 21, 2019 and March 23, 2019 respectively.

 

All the work associated with aeration basins 2,3 and 4 has been completed and returned to service but the official 30-day demonstration test remains to be completed for Intermediate Lift Pump (ILP#7). The work associated with aeration basin # 1 also is completed. Currently the Contractor is conducting the system acceptance test (SAT) for aeration basin # 1 and working on the punch list items.

 

JUSTIFICATION

The project has experienced some unforeseeable delays and include:

1.                     Shut down approval delay of ILP No. 7 due to operational needs/permit restrictions

2.                     Aeration basin No. 2 rehabilitation work completion and SAT completion delay due to operational needs and contractor delays

3.                     Aeration basin No.1 structural modification and SAT completion delay due to operational needs

4.                     Roof top platform installation delay due to unexpected site deficiencies.  As of January 31, 2019, approximately 97% of the base contract work has been completed.

 

However, substantial completion requires that the following items are successfully completed:

1.                     SATs for: VFD Nos. 3,4 & 7 and Aeration basin No. 1;

2.                     harmonic analysis of the VFD system; and

3.                     completion of the 30-day test for VFD# 7.  

The Contractor has submitted a delay claim letter to GLWA on December 18, 2018 stating that GLWA has caused a 66 days delay to the project.

After a detailed analysis of all the delays on this project after the execution of change order No.1, GLWA and Weiss has agreed that both parties were responsible for the delays and that a 90 calendar days extension is needed to complete this project.   Therefore, a contract time extension of 90 calendar days to both the substantial completion and final completion, at no cost to GLWA and the Contractor, is requested in this proposed change order No. 2 per Article 8.4.2 of the General Conditions of the Contract. This time extension will also allow enough time to complete any remaining punch list work items and close out documents.

FINANCIAL PLAN IMPACT

This change order is for an extension of time only.  There is no substantive financial impact.

COMMITTEE REVIEW

This item was presented to the Operations and Resources Committee at its meeting on March 13, 2019.  The Operations and Resources Committee unanimously recommended that the GLWA Board adopt the resolution as presented.

SHARED SERVICES IMPACT

This item does not impact the shared services agreement between GLWA and DWSD.
