RE: Proposed Amendment No. 1 to Water Service Contract with City of Flint
MOTION
Upon recommendation of Randal Brown, General Counsel, the Board of Directors ("Board") of the Great Lakes Water Authority ("GLWA"), authorizes the Chief Executive Officer ("CEO"), upon receipt of the necessary concurrences from the Karegnondi Water Authority, Genesee County Drain Commissioner, and the State of Michigan, to execute Amendment No. 1 to the 30-year water service contract with City of Flint; and authorizes the CEO to take such other action as may be necessary to accomplish the intent of this vote.
BACKGROUND
This Amendment No. 1 ("Amendment"), and all future amendments to the Flint water service contract, is subject to the terms of the Master Agreement between GLWA, the City of Flint, the Genesee County Drain Commissioner (GCDC), the Karegnondi Water Authority (KWA) and the State of Michigan (SOM). The terms of the Master Agreement require that any and all amendments to certain agreements incorporated as a part of the Master Agreement, the Flint water service contract included, be approved by all parties to the Master Agreement. Staff is currently working to secure the approvals for this Amendment from GCDC, KWA and SOM.
On 11/29/2018, the Flint ("Member Partner") City Council agreed to the terms of the Amendment to the Water Service Contract with GLWA. This Amendment is one of several regularly occurring amendments as mandated by the terms of the standard 30-year water service contracts with GLWA's member partners.
