RE:                     Gordie Howe Bridge Easement Agreement between MDOT and GLWA

                                          

MOTION

 

Upon recommendation and opinion of Randal M. Brown, General Counsel, the Board of Directors (Board) for the Great Lakes Water Authority (GLWA) recommends the (1) approval of an Easement Agreement between GLWA and the Michigan Department of Transportation and (2) authorization for the Chief Executive Officer to take such other action as may be necessary to accomplish the intent of this vote, including the execution of an Easement Agreement. 

 

JUSTIFICATION

Within the proposed footprint of the Gordie Howe Bridge, the Great Lakes Water Authority operates and maintains Leased Facilities. Specifically, there is a sewer line underneath Dragoon in the City of Detroit.  GLWA needs an easement agreement to gain access to the Dragoon sewer line within the footprint of Bridge. Without an easement agreement, GLWA’s access rights to the property will be compromised. A form of easement agreement is attached.

 

 

BUDGET IMPACT

This request does not impact the GLWA’s budget.

COMMITTEE REVIEW

This matter was presented to the Legal Committee at its October 24, 2018 meeting.  The Legal Committee unanimously recommended that the GLWA Board adopt the resolution as presented.

SHARED SERVICES IMPACT

This request does not impact the Shared Services Agreement.
