RE: Request to Authorize GLWA's CEO to Execute Easements To Access Leased Water and Sewer Facilities

MOTION

Upon recommendation of Randal M. Brown, General Counsel, the Board of Directors (Board) of the Great Lakes Water Authority (GLWA):
1) Authorizes GLWA's Chief Executive Officer (CEO) to execute on behalf of the GLWA, easements for GLWA owned and Leased Water and Sewer Facilities without further approval of the Board;
2) Authorizes the CEO to take such other action as may be necessary to accomplish the intent of this vote.
BACKGROUND
When DWSD managed the entire system, it was unnecessary for DWSD to secure easements to install and maintain regional water and sewer facilities on City of Detroit property and within roadways under the jurisdiction of the City of Detroit. Recently, real estate development and infrastructure projects, like the Goodie Howe Bridge, have resulted in the City of Detroit transferring ownership to properties and jurisdiction over roadways where GLWA Leased Water and Sewer Facilities are located. Similar issues are presented where, the City of Detroit has vacated roadways. When the City of Detroit engages in these transactions, GLWA needs to protect its rights to access the Leased Water and Sewer Facilities, through easements.
JUSTIFICATION
GLWA needs easements to protect its ability to access its Leased Water and Sewer Facilities within the City of Detroit.
