MOTION
Upon recommendation and opinion of Randal M. Brown, General Counsel, the Legal Committee for the Great Lakes Water Authority (GLWA):
1) Recommends to the Board that the General Counsel negotiates the purchase of Conrail Right of Way in Detroit, MI.
JUSTIFICATION
This unused portion of Conrail right of way in Detroit, MI is needed by Wastewater Operations to complete the Water Resource Recovery Facility Third Feed. The Purchase Price is $58,000, which is reasonable compared to GLWA’s recent appraisal of the property.
BUDGET IMPACT
This purchase was anticipated in Wastewater Operations Budget.
COMMITTEE REVIEW
The Legal Committee reviewed details of the proposed transaction on April 25, 2018. The Legal Committee unanimously recommended that the GLWA Board adopt the resolution as presented.
SHARED SERVICES IMPACT
There is no impact on the Shared Services Agreement.
