MOTION
Upon recommendation and opinion of Randal M. Brown, Deputy Chief Administrative and Compliance Officer/General Counsel, the Board of Directors (Board) for the Great Lakes Water Authority (GLWA) recommends the (1) approval of a Possession and Use Agreement between GLWA and 51172 Dequindre, LLC, the property owner of Parcel 8 Vacant Land, Rochester Hills, MI 48307, Tax ID No 70-15-13-477-002; and (2) authorization for the Chief Executive Officer to take such other action as may be necessary to accomplish the intent of this vote, including the execution of a Possession and Use Agreement.
JUSTIFICATION
GLWA needs to acquire a possession and use of property owned by 51172 Dequindre, LLC. The possession and use agreement is needed in conjunction with 96-inch water main relocation project. Without this agreement, GLWA cannot move forward with 96-inch water main relocation project in the most cost-effective manner. At the request of 51172 Dequindre, LLC, payment of the consideration would be made to Yates Cider Mill, LLC.
BUDGET IMPACT
Property acquisitions were included in the budget for the 96-inch relocation project.
COMMITTEE REVIEW
This matter was being presented to the Legal Committee on September 27, 2023. The Legal Committee unanimously recommended that the GLWA Board adopt the resolution as presented.
