MOTION

 

Upon recommendation and opinion of Randal M. Brown, General Counsel, the Board of Directors (Board) for the Great Lakes Water Authority (GLWA) (1) approves an Easement Agreement between GLWA and Tom Holzer Ford, Inc. and CL, LLC and (2) authorizes the Chief Executive Officer to take such other action as may be necessary to accomplish the intent of this vote, including the execution of an Easement Agreement. 

 

JUSTIFICATION

GLWA needs to acquire permanent and temporary construction easements over property owned by Tom Holzer Ford, Inc. and CL, LLC and located at 39300 West Ten Mile Road.  The easements are needed in conjunction with the 14 Mile Road Loop Project. Without an easement agreement, GLWA’s ability to construct the 14 Mile Road Loop Project will be compromised.

 

BUDGET IMPACT

Easement acquisitions were included in the budget for the 14 Mile Road Loop Project.

COMMITTEE REVIEW

This matter was presented to the Legal Committee on December 17, 2020.  The Legal Committee unanimously recommended that the GLWA Board adopt the resolution as presented.

SHARED SERVICES IMPACT

This request does not impact the Shared Services Agreement.
