MOTION

 

Upon recommendation and opinion of Randal M. Brown, General Counsel, the Legal Committee for the Great Lakes Water Authority (GLWA):

 

1)                     Recommends to the Board that the General Counsel negotiate the sale of property in Goodland Township to the prior owner, Brenda Turner.

 

JUSTIFICATION

On or about December 19, 2016, the Great Lakes Water Authority (GLWA) purchased 0.5 acres in Goodland Township, Michigan from Brenda Turner.  GLWA purchased the property for $8,000.00. The purchase was the result of a settlement of a condemnation proceeding. At the time, the property was the potential site for a booster chlorination station. As a result of the Master Agreement between GLWA, the State of Michigan, the City of Flint, the Genesee County Drain Commissioner and the Karegnondi Water Authority, GLWA is no longer in need of the purchased property. Ms. Turner agreed to repurchase the property for $8,000.00 plus GLWA paying all closing costs.

 

 

BUDGET IMPACT

The budget impact of this Agreement does not adversely impact the GLWA’s ability to perform its current and proposed financial plan and/or provides revenue to the GLWA.

COMMITTEE REVIEW

The Legal Committee reviewed details of the proposed transaction on May 23, 2018.  The Legal Committee unanimously recommended that the GLWA Board adopt the Resolution as presented.

SHARED SERVICES IMPACT

There is no impact to the Shared Services Agreement.
