MOTION
Upon recommendation and opinion of Randal M. Brown, Deputy Chief Administrative and Compliance Officer/General Counsel, the Board of Directors (Board) for the Great Lakes Water Authority (GLWA): (1) approves an Easement Agreement between GLWA and Dennis and Deborah Hayden, the property owner of 51172 Dequindre Road, Shelby Township, MI 48307; and (2) authorizes the Chief Executive Officer to take such other action as may be necessary to accomplish the intent of this vote, including the execution of an Easement Agreement.
JUSTIFICATION
GLWA needs to acquire a temporary easement over property owned by Dennis and Deborah Hayden. The easement is needed in conjunction with 96-inch water main relocation project. Without an easement agreement, GLWA cannot move forward with 96-inch water main relocation project in the most cost-effective manner.
BUDGET IMPACT
Easement acquisitions were included in the budget for the 96-inch relocation project.
COMMITTEE REVIEW
This matter was being presented to the Legal Committee on September 27, 2023. The Legal Committee unanimously recommended that the GLWA Board adopt the resolution as presented.
SHARED SERVICES IMPACT
This request does not impact the Shared Services Agreement.
