RE: Easement Agreement between GLWA and Suburban Haggerty Property, LLC
MOTION
Upon recommendation and opinion of Randal M. Brown, General Counsel, the Board of Directors (Board) for the Great Lakes Water Authority (GLWA) recommends the (1) approval of Easement Agreements between GLWA and Suburban Haggerty Property, LLC and (2) authorization for the Chief Executive Officer to take such other action as may be necessary to accomplish the intent of this vote, including the execution of an Easement Agreement.
JUSTIFICATION
GLWA needs to acquire permanent and temporary construction easements over property owned by Suburban Haggerty Property LLC and located at 25000 Haggerty Road. The easements are needed in conjunction with the 14 Mile Road Loop Project. Without an easement agreement, GLWA’s ability to construct the 14 Mile Road Loop Project will be compromised.
BUDGET IMPACT
Easement acquisitions were included in the budget for the 14 Mile Road Loop Project.
COMMITTEE REVIEW
This matter was being presented to the Legal Committee on March 24, 2021. The Legal Committee unanimously recommended that the GLWA Board adopt the resolution as presented.
SHARED SERVICES IMPACT
This request does not impact the Shared Services Agreement.
