RE: First Amendment to Lease between GLWA and T-MOBILE USA TOWER LLC by and through CCTMO LLC for a portion of land within the Adams Road Pump Station. The new term of the extended lease will be July 21, 2029, to July 20, 2059.
MOTION
Upon recommendation and opinion of Phyllis Hurks, General Counsel, the Board of Directors (Board) for the Great Lakes Water Authority (GLWA) (1) approves and authorizes:
a) the execution of a first lease amendment between GLWA and T-MOBILE USA TOWER LLC, by and through CCTMO LLC, for a portion of land within the Adams Road Pump Station for an additional period of thirty years ending July 20,2059;
b) payment of a base rent at $40,000 per year, with 3% yearly increases for the life of the lease;
c) a one-time $10,000 payment to GLWA upon execution of the first amendment and 50% of the rental, license or similar payments actually received by T-Mobile from future subtenants; and
(2) authorizes the Chief Executive Officer to take such other action as may be necessary to accomplish the intent of this vote.
BACKGROUND
The City of Detroit, by and through the Detroit Water and Sewage Department ("DWSD"), and Omnipoint Communications Midwest Operations LLC ("Omnipoint") entered into a Lease Agreement dated August 4, 1999("LA-1535"), whereby leased to Omnipoint a portion of land located at 6201 Adams Road, Bloomfield Hills, Oakland County, State of Michigan owned by DWSD to construct and operate a telecommunications tower.
