MOTION

 

Upon recommendation and opinion of Randal M. Brown, General Counsel, the Board of Directors (Board) for the Great Lakes Water Authority (GLWA) recommends the (1) approval of an Easement Agreement between GLWA and Serra Auto Works; and (2) authorization for the Chief Executive Officer to take such other action as may be necessary to accomplish the intent of this vote, including the execution of an Easement Agreement. 

 

JUSTIFICATION

GLWA needs to acquire temporary access easement over property owned by Serra Auto Works and located at 39000 West Ten Road.  The easement is needed in conjunction with the 14 Mile Road Loop Project. Without an easement agreement, GLWA’s construction costs for the project will likely increase in excess of $42,400.00.

 

BUDGET IMPACT

Easement acquisitions were included in the budget for the 14 Mile Road Loop Project.

COMMITTEE REVIEW

This matter was being presented to the Legal Committee on October 26, 2022. The Legal Committee unanimously recommended that the GLWA Board adopt the resolution as presented.

SHARED SERVICES IMPACT

This request does not impact the Shared Services Agreement.
