MOTION

 

Upon recommendation and opinion of Randal M. Brown, General Counsel, the Board of Directors (Board) for the Great Lakes Water Authority (GLWA) recommends the (1) approval of an Easement Agreement between GLWA and Waterfront Terminal Holdings, LLC and Waterfront Terminal Holdings II, LLC (the Waterfront Entities) and (2) authorization for the Interim Chief Executive Officer to take such other action as may be necessary to accomplish the intent of this vote, including the execution of an Easement Agreement. 

JUSTIFICATION

GLWA needs to acquire easements over properties owned by the Waterfront Entities.  The easements are needed in conjunction with near-term work to Outfall B-39. The easement agreement will allow for future work on Outfalls B-36, 37 and 38 as well. Without an easement agreement, GLWA’s ability to improve these outfalls will be compromised. Through negotiations, GLWA will pay $36,000.00 for the easements across the Waterfront Entities’ properties.

 

 

BUDGET IMPACT

Easement acquisitions were included in the budget for Outfall B-39 rehabilitation.

COMMITTEE REVIEW

This matter is being presented directly to the Board so that work on Outfall B-39 can commence.

SHARED SERVICES IMPACT

This request does not impact the Shared Services Agreement.
