MOTION

 

Upon recommendation and opinion of Randal M. Brown, Deputy Chief Administrative and Compliance Officer/General Counsel, the Board of Directors (Board) for the Great Lakes Water Authority (GLWA): (1) approves an Easement Agreement between GLWA and Douglas Hoyt, the property owner at 12241 E. Potter, Davison, MI 48423; and (2) authorizes the Chief Executive Officer to take such other action as may be necessary to accomplish the intent of this vote, including the execution of an Easement Agreement. 

 

JUSTIFICATION

GLWA needs to acquire a permanent easement over property owned by Douglas Hoyt.  The easements are needed in conjunction with upgrading the FL-01-meter pit, which measures the flow of water supplied to the city of Flint. Without an easement agreement, GLWA and the city of Flint cannot move forward with upgrading the meter pit in the most cost-effective manner.

 

BUDGET IMPACT

Easement acquisitions were included in the budget for the Meter Operations and the acquisition costs may reimbursed by the city of Flint for this Easement Agreement.

COMMITTEE REVIEW

This matter was presented to the Legal Committee at its meeting on July 26, 2023. The Legal Committee unanimously recommended that the GLWA Board adopt the resolution as presented.

This request does not impact the Shared Services Agreement.
