MOTION

Upon recommendation and opinion of Suzanne R. Coffey, Chief Executive Officer, William M. Wolfson, Deputy Chief Executive Officer, and David W. Jones, General Counsel, the Board of Directors for the Great Lakes Water Authority (GLWA): (1) approves and authorizes the execution of a Settlement Agreement between the Great Lakes Water Authority (GLWA) and the American Moslem Society (AMS) in connection with Great Lakes Water Authority v. Adolph N. Mario, or his unknown heirs, devisees, legatees, and assigns, et al.; and (2) authorizes the Chief Executive Officer to take such other action as may be necessary to accomplish the intent of this vote.




JUSTIFICATION
GLWA and AMS have agreed to the settlement amount and the final settlement of the AMS's interests in the lawsuit and any and all amounts that may be alleged by AMS to be due and owing under the Uniform Condemnation Procedures Act or pursuant to the lawsuit.

BUDGET IMPACT
Property acquisitions were included in the Triple Barrel Baby Creek Enclosure Sewer project budget.
