MOTION

Upon recommendation of Navid Mehram, Chief Operating Officer - Wastewater Operating Services, the Board of Directors (Board) of the Great Lakes Water Authority (GLWA), authorizes the Interim Chief Executive Officer (ICEO) to enter into Contract No. GLWA-CON-234, Proposed Change Order No. 5, "Conner Creek CSO Basin Emergency Rehabilitation" with Weiss Construction Company LLC., for no increase in cost, for a total cost not to exceed $7,264,874.00 and an increased duration of 90 days for a total contract duration of 1,546 days; and authorizes the ICEO to take such other action as may be necessary to accomplish the intent of this vote. 

 

BACKGROUND

GLWA-CON-234 contract was awarded to Weiss Construction Company with a start-to-work date of June 12, 2018, and a final completion date of December 12, 2019. The scope of work included repairing Seats and Seals of all sixteen (16) Effluent Launder Gates (ELG) and five (5) Effluent Relief Gates (ERG).

On April 11, 2019, GLWA authorized Weiss Construction Company to replace Seats and Seals to the remaining eleven (11) ERG gates via Change Order No.1 and extended the substantial and final completion dates by 270 calendar days to June 11, 2020, and September 7, 2020, respectively.

On December 5, 2019, GLWA authorized Weiss Construction Company to install new influent flow meter equipment and related improvements for the Conner Creek CSO facility and the Freud Pump Station via Change Order No. 2. Change Order No. 2 also extended the final completion date by 90 calendar days to December 6, 2020.

On January 15, 2021, GLWA extended the final completion date of the CON-234 Contract to June 6, 2021, via Change Order No. 3 to allow time for GLWA to inspect the remaining gates and determining the condition of the seats/seals installed by Weiss.

 

On September 10, 2021, GLWA extended the final completion date of the CON-234 Contract to June 6, 2022, via Change Order No. 4 to investigate the failed Effluent Relief Gates (ERG) top PVC Seats and perform warranty work on four ERG Gates (2D, 4B, 1A and 1C) that failed within the warranty period. This work was completed on October 1, 2021.

 

On December 17, 2021, two ERG gates 3C and 3D were found to be leaking, and GLWA issued a Construction Change Directive (CCD-K) to perform this work using money from the provisionary allowance. 

 

JUSTIFICATION

 

Work to replace ERG Gates PVC seats requires warm weather and basin availability. The Contractor plans to perform the rehabilitation work authorized under CCD-K from end of April to early June. Considering the potential for wet weather and basin availability, GLWA staff recommends extending the final completion time by 90 days from June 6, 2022, to September 4, 2022, to allow sufficient time for this work to be completed correctly.

 

GLWA/Contractor wants to perform the work authorized under CCD-K during warm weather and around wet weather and hence recommend extending the contract to avoid it expiring as we try to plan for this work.
