MOTION

 

Upon recommendation and opinion of William M. Wolfson, Chief Administrative and Compliance Officer/Interim General Counsel, the Board of Directors for the Great Lakes Water Authority hereby: (1) approves a permanent easement with East Jefferson Development Corporation for the north 20’ of the property located at 14701 East Jefferson Avenue, Detroit, MI, 48215 (Tax Parcel No. 21000607), including the execution of the Permanent Easement Agreement and related documents; and (2) authorizes the Chief Executive Officer to take such other action as may be necessary to accomplish the intent of this vote. 

 

 

JUSTIFICATION

 

The Fox Creek project involves repairing and protecting critical components of GLWA's east-side sewer infrastructure, providing dry-weather sewage transmission and wet-weather flood mitigation to the east side of Detroit and surrounding communities. GLWA must acquire this property to rehabilitate the Fox Creek outfall and regulator chambers.

 

BUDGET IMPACT

 

There are sufficient funds allocated for this permanent easement agreement in the CIP.

 

COMMITTEE REVIEW

 

This matter was presented to the Legal Committee at its meeting on December 13, 2023. The Legal Committee unanimously recommended that the GLWA Board adopt the resolution as presented.

SHARED SERVICES IMPACT

 

This request does not impact the Shared Services Agreement between GLWA and DWSD.
