RE:                     Easement Agreement between GLWA and Southeastern Oakland County Resource Recovery Authority, Property Owner of 1741 School Road, Rochester Hills, MI 48307, Tax Parcel No.: 70-15-24-200-004

MOTION

Upon recommendation and opinion of Randal M. Brown, Deputy Chief Administrative and Compliance Officer/General Counsel, the Board of Directors (Board) for the Great Lakes Water Authority (GLWA): (1) approves an Easement Agreement between GLWA and Southeastern Oakland County Resource Recovery Authority (SOCRRA), the property owner of 1741 School Road, Rochester Hills, MI 48307, Tax Parcel No.: 70-15-24-200-004; and (2) authorizes the Chief Executive Officer to take such other action as may be necessary to accomplish the intent of this vote, including the execution of an Easement Agreement.

JUSTIFICATION

GLWA needs to acquire a temporary easement over property owned by SOCRRA.  The consideration to SOCRRA is inclusive of the value of the temporary easement and increased trucking costs associated with avoiding the 96-inch water main relocation project. The easement is needed in conjunction with 96-inch water main relocation project. Without an easement agreement, GLWA cannot move forward with 96-inch water main relocation project in the most cost-effective manner.

BUDGET IMPACT

Easement acquisitions were included in the budget for the 96-inch relocation project.
