MOTION
Upon recommendation of Navid Mehram, Chief Operating Officer - Wastewater Operating Services, the Board of Directors (Board) of the Great Lakes Water Authority (GLWA), authorizes the Chief Executive Officer (CEO) to enter into Contract No. GLWA-1802410, Proposed Change Order No. 4, “Rehabilitation of Various Sampling Sites & PS2 Ferric Chloride System” with Commercial Contracting Corporation, at no increase in cost, for a total cost not to exceed $6,556,222.00 and an increased duration of 180 days for a total contract duration of 1,631 days; and authorizes the CEO to take such other action as may be necessary to accomplish the intent of this vote.
BACKGROUND
On February 18, 2019, Great Lakes Water Authority awarded the Contract GLWA-1802410 (Rehabilitation of Various Sampling Sites & Pump Station No. 2 Ferric Chloride System), to Commercial Contracting Corporation. This Contract is comprised of two Packages A and B. Package A included the rehabilitation of various sampling sites contained within the GLWA Water Resource Recovery Facility (WRFF). Package B included the replacement of existing Ferric Chloride Tanks and associated transfer and feed pumps at Pump Station No. 2.
Change Order No.1 was approved by the Board on March 25, 2020, for a not to exceed amount of $806,137 for the modified Package B work.
Change Order No. 2 was approved by the Board on January 27, 2021, for a not to exceed amount of $776,165.00 for the modified Package A work, and time extension of 365 days to the substantial completion and final completion. The revised substantial completion date was August 11, 2021, and the revised final completion date was February 7, 2022.
Change Order No. 3 was approved by the Board on January 26, 2022, for a not to exceed amount of $217,920.00 to undertake the feed pump skid related changes including general conditions, and time extension of 365 days to the substantial completion and final completion. The revised substantial completion date was August 11, 2022, and the revised final completion date is February 7, 2023.
The contract has experienced additional delays related to Package A steel platform and Package B feed pump skid installation. Therefore, this proposed Change Order No. 4 requests additional time to complete these improvements.
JUSTIFICATION
The contract has experienced additional delays related to Package A steel platform and Package B Ferric Chloride feed pump skid. Package A delays were due to changes made to the ML-1 (WAS) building roof platform design. The design was modified to better fit GLWA’s HAZMAT Team’s training needs. Package B delays were due to deficiencies with installation of the Ferric Chloride feed pump skid and related mechanical, electrical and controls. The Contractor has corrected most of the deficiency items and expects to complete Package A and B work by January 2023.
The Contractor requested to extend Substantial Completion to January 30, 2023, and final completion to March 15, 2023. However, GLWA staff recommends extending the substantial completion date by 172 days to January 30, 2023, and the final completion date by 180 days to August 6, 2023 (to allow enough time for the project close out process). Therefore, a time extension of 172 days to the substantial completion and 180 days to final completion is requested via this Proposed Change Order No. 4 to allow enough time after Board approval for the contractor to complete all contractual requirements.
