MOTION
Upon recommendation and opinion of William M. Wolfson, Chief Administrative and Compliance Officer/ Interim General Counsel, the Board of Directors (Board) for the Great Lakes Water Authority (GLWA): (1) approves Amendment No 4. to Legal Services Contract GLWA LS-1905087 with Zausmer P.C.; and (2) authorizes the Chief Executive Officer to take such other action as may be necessary to accomplish the intent of this vote, including the execution of Amendment No 4. to Legal Services Contract GLWA LS-1905087 with Zausmer P.C.
JUSTIFICATION
GLWA retained Zausmer P.C. to handle real estate matters including condemnation matters if necessary. Property acquisition either through deeds or easements are necessary to complete capital projects in the field. Zausmer P.C.’s assistance is needed to continue to represent GLWA in these matters. This amendment extends the time two years and increases the total compensation by $150,000.00 to $650,000.00. Due to the amendment extending services beyond 5 years, Board approval is required.
BUDGET IMPACT
There are sufficient funds allocated in the General Counsel’s budget for the continuation of Zausmer P.C.’s services.
COMMITTEE REVIEW
This matter is being presented to the Legal Committee on October 25, 2023. The Legal Committee unanimously recommended that the GLWA Board adopt the resolution as presented.
SHARED SERVICES IMPACT
This request does not impact the Shared Services Agreement.
