MOTION
Upon recommendation of Navid Mehram, Chief Operating Officer - Wastewater, the Board of Directors (Board) of the Great Lakes Water Authority (GLWA), authorizes the Chief Executive Officer (CEO) to enter into Contract No. CON-234, Proposed Change Order No. 4, "Conner Creek CSO Basin Emergency Rehabilitation" with Weiss Construction Company LLC., for no increase in cost, for a total cost not to exceed $7,264,874.00 and an increased duration of 365 days for a total contract duration of 1,455 days; and authorizes the CEO to take such other action as may be necessary to accomplish the intent of this vote.
BACKGROUND
GLWA-CON-234 contract was awarded to Weiss Construction Company with a start-to-work date of June 12, 2018, and a final completion date of December 12, 2019. The scope of work included repairing Seats and Seals of all sixteen (16) Effluent Launder Gates (ELG) and five (5) Effluent Relief Gates (ERG).
On April 11, 2019, GLWA authorized Weiss Construction Company to replace Seats and Seals to the remaining eleven (11) ERG gates via Change order No.1 and extended the substantial and final completion dates by 270 calendar days to June 11, 2020, and September 7, 2020, respectively.
On December 5, 2019, GLWA authorized Weiss Construction Company to install new influent flow meter equipment and related improvements for the Conner Creek CSO facility and the Freud Pump Station via Change Order No.2. Change Order No. 2 also extended the final completion date by 90 calendar days to December 6, 2020.
Rehabilitation work for all the gates was substantially completed on March 1, 2020. However, several of the rehabilitated gates had experienced leaks before substantial completion and after substantial completion. Therefore, GLWA had extended the final completion date of the CON-234 Contract to June 6, 2021, via Change Order No.3 to allow time for GLWA to inspect the remaining gates and determining the condition of the seats/seals installed by Weiss.
JUSTIFICATION
On December 2, 2020, GLWA procured the services of HDR Michigan, Inc. (HDR) for third-party verification for the gate repairs performed by the Weiss team. HDR performed the field inspection on January 27, 2021, and the findings indicate that the gate restoration was not performed per the specification. For example, the surface preparation did not comply with the epoxy manufacturer’s requirements to create a proper bonding between the PVC seat and gate frame. The failure in the seals allows for leakage rates exceeding the contract requirements for each gate making the work defective.
GLWA issued a defective work notice to Weiss on March 2, 2021. The defective work order requires Weiss Construction to submit a corrective action plan on how they intend to correct the defective work. On April 26, 2021, Weiss construction submitted the corrective action plan however, it was found unacceptable. GLWA requested Weiss to revise and resubmit the plan and the revised plan is expected to be submitted in early June.
Currently, the revised final completion date of CON-234 is June 6, 2021. GLWA intends to continue working with Weiss construction on the corrective action plan with the anticipation to have an approved corrective plan by mid-June. The approval of this change order request will allow Weiss to proceed with correcting the defective work shortly after the plan is approved by GLWA. Therefore, GLWA staff recommends extending the final completion time by 365 days to allow the Weiss team to correct the defective work, and GLWA to complete the necessary inspection prior to close out of the project.
