MOTION
Upon recommendation of Navid Mehram, Chief Operating Officer - Wastewater Operating Services, the Board of Directors (Board) of the Great Lakes Water Authority (GLWA), authorizes the Chief Executive Officer (CEO) to amend the existing Contract No. GLWA-CS-1781, “Oversight Services for Progressive Design-Build Rouge River Outfall Project” with PMA Consultants, LLC, and at an increased cost of $148,155.00 for a total cost not to exceed $2,569,875.00, and an increased duration of 194 calendar days for a total contract duration of 1,412 days; and authorizes the CEO to take such other action as may be necessary to accomplish the intent of this vote.
BACKGROUND
On September 12, 2016, Great Lakes Water Authority (GLWA) awarded this contract to provide owner’s representation, project oversight, and other related professional services in connection with GLWA’s PC-797 Rouge River Outfall Disinfection Project. The scope of work includes representing GLWA’s interest and overseeing the project design and construction which is being performed under a separate GLWA progressive design-build contract PC-797. Specific oversight services include: design and construction oversight and monitoring, cost analyses, submittal reviews, schedule management, contract administration and coordination, claims and changes management and close-out and final completion assistance.
The original required final completion date of the CS-1781 contract was December 19, 2019, predicated upon the requirement that the PC-797 progressive design-build contract would reach substantial completion by April 1, 2019 and final completion by December 31, 2019.
The PC-797 progressive design-build contract was sufficiently completed by April 1, 2019 to meet NPDES permit requirements, but unanticipated chlorine leaks, lack of a final certificate of occupancy, and a variety of other issues prevented successful completion of demonstration testing and substantial completion until September 12, 2019. As of October 31, 2019, approximately 98.7% of the PC-797 base contract work has been completed. Currently the PC-797 Contractor is working to complete final work on the punch list as well as a few recent change items requested by GLWA, so that the project can be closed out. The PC-797 Contractor has requested an extension of time for final completion until June 30, 2019.
JUSTIFICATION
Oversight and contract administration services are needed until final completion of Contract PC-797. During the execution of the work the PC-797 Contractor experienced a combination of delays to these dates. Specifically, the Contractor encountered significant unanticipated conditions that included numerous underground utilities that were discovered to be in unexpected locations, requiring design and construction changes. To address these unanticipated conditions, as well as to provide needed project enhancements, GLWA has issued Construction Change Directives for some 62 work items, increasing the volume of required Contract work by about 11%. Among other items, project enhancements have included:
• Improved sulfur dioxide gas alarms for employee safety
• A redundant sodium hypochlorite line to disinfect dry weather secondary effluent
to allow for increased operational/maintenance flexibility
Also, a variety of unanticipated issues and delays within the responsibility of the PC-797 Contractor (e.g.,. chlorine leaks; delays in completing integration to make the security system functional) also contributed to the delay).
Because the PC-797 Contractor will not reach final completion on time and has requested a time extension to June 30, 2020, the completion date of Contract CS-1781 must also be extended to the same date in order to provide uninterrupted and consistent CS-1781 owner’s oversight of the PC-797 remaining work, including assistance with contract administration and resolution of the PC-797 Contractor’s remaining changes and claims. Therefore, a compensable final completion time extension for the CS-1781 Oversight Consultant of 194 calendar days is requested (December 19, 2019 to June 30. 2020). This compensable time extension will also allow enough time for the CS-1781 Oversight Consultant to monitor and oversee the PC-797 Contractor’s completion of any remaining punch list and any Owner added enhanced work items and close out documents. CS-1781 Vendor (PMA Consultant, LLC) has requested 194 calendar day extension to their contract time and $217,011 additional cost associated with this time extension via their letter dated November 15, 2019. This additional cost request is reviewed by GLWA and found to be fair and reasonable. Since $68,856 is available in the CS-1781 Contingency per the issued Change Directive-A, the additional cost requested via this Amendment No.1 is $148,155 ($217,011-$68,856).

FINANCIAL PLAN IMPACT
Capital Improvement Plan: No change in CIP budget is required as a result of this Amendment No.1. The CIP budget for the Rouge River Outfall Disinfection Project (CIP No. 212006) is $48,033,000.00, which is adequate for both Contract PC-797 at $44,461,636.00 and Contract CS-1781 at the proposed amount of $2,569,875.00.
This contract revision is necessary because it delivers continued and consistent owner’s oversight services over a critical GLWA project that is necessary for continuing compliance with NPDES permit requirements regarding disinfection of discharges at the Water Resource Recovery Facility.
COMMITTEE REVIEW
This item was presented to the Operations and Resources Committee at its meeting on December 11, 2019. The Operations and Resources Committee unanimously recommended that the GLWA Board adopt the resolution as presented.
