MOTION
Upon recommendation and opinion of Suzanne R. Coffey, Chief Executive Officer, and David W. Jones, General Counsel, the Board of Directors for the Great Lakes Water Authority (GLWA), moves for the following:
(1) approval and execution of a Permanent Easement Agreement between GLWA and Elizabeth Eldridge, (owner of certain mineral rights on the Woodmere Cemetery); and
(2) authorizes the Chief Executive Officer to take such other action as may be necessary to accomplish the intent of this vote.
JUSTIFICATION
GLWA must acquire this permanent easement to allow for maintenance of the existing Triple Barrel Baby Creek Enclosure Sewer (“Sewer”). In particular, GLWA needs to clear the Sewer of sediment that has built up over the years, limiting flow. If the sediment is not removed, it could lead to backups, flooding of basements in the area, and even a sinkhole in the Cemetery itself.
BUDGET IMPACT
Property acquisitions were included in the Triple Barrel Baby Creek Enclosure Sewer project budget.
COMMITTEE REVIEW
This matter was presented to the Legal Committee at its meeting on October 23, 2024. The Legal Committee unanimously recommended that the GLWA Board adopt the resolution as presented.
