MOTION

 

Upon recommendation of Navid Mehram, Chief Operating Officer - Wastewater Operating Services, the Board of Directors (Board) of the Great Lakes Water Authority (GLWA), authorizes the Chief Executive Officer (CEO) to enter into Contract No. 2002190, Proposed Change Order No. 2, “Rehabilitation of Ferric Chloride Feed System and Sludge Lines” with Weiss Construction Co., LLC, with an increase in cost of $300,000.00 for a total cost not to exceed $10,139,000.00 and an increased duration of 190 days for a total duration of 1,164 days; and authorizes the CEO to take such other action as may be necessary to accomplish the intent of this vote. 

BACKGROUND

This project is intended to improve the reliability of the ferric chloride feed system at Pump Station No. 1 and the thickened waste activated sludge (TWAS) piping between Complex B and Complex A at the Water Resource Recovery Facility (WRRF). The scope of work includes replacement of the existing ferric chloride feed system with new pumps and appurtenances, new ferric chloride storage tank and appurtenances, as well as modification and chemical cleaning of the TWAS pipeline from Complex B to Complex A.

The original agreement required substantial completion of the project on October 7, 2022. Change Order No. 1 extended the substantial completion date to June 8, 2023, due to delays in obtaining a Conrail permit to install the temporary TWAS piping below the railroad right-of-way which would allow chemical cleaning of the existing TWAS line. As of this letter, the new ferric chloride system has passed system acceptance testing and three rounds of chemical cleaning have been performed to remove vivianite mineral deposits from the TWAS pipeline from Complex B. Unfortunately, the inspection of the TWAS pipeline identified additional cleaning necessary. GLWA is working with the contractor to coordinate the fourth round of cleaning.

JUSTIFICATION

In March 2023, when Change Order No. 1 was executed to extend the final completion date, the Contractor anticipated that the TWAS line would require one round of chemical cleaning, which would be completed by May 19, 2023. Despite Contractor efforts through three rounds of cleaning, by early October 2023, the Contractor still has not been able to demonstrate cleaning results that met agreement requirements. Contractor’s inability to perform the chemical cleaning of the existing TWAS line in accordance with the project specifications and within the agreed upon time period has delayed the completion of the project. A fourth round of cleaning is being coordinated to begin in mid-October with completion expected in late November, approximately 190 days later than planned.

Also, completion and testing of the new Pump Station No. 1 ferric chloride system was also delayed, with system testing not completed until September 14, 2023, 98 days after required substantial completion. Chemical building finishes have not been completed, and demolition continues at the old pickle liquor tanks and chemical sump.

As a result of all these issues, it is necessary to extend the contract time by 190 calendar days to allow the Contractor to complete the work, without affecting the final completion date of December 5, 2023.

Additionally, the Contractor has provided notice of claim to GLWA regarding change conditions that have hindered its chemical cleaning, required extra work, delayed completion, and increased cost experienced. GLWA is currently in discussion with the contractor regarding the claims in determining the fair and equitable approach forward.

GLWA recommends an increase to the contract price by $300,000.00 to restore funding provided within the contract provisional allowance to enable GLWA to resolve remaining contract related items as the project approaches completion.
