RE: Proposed Amendment No. 1
Contract No. GLWA-CS-213
Environmental Health and Safety Compliance Services
Vendor: NTH Consultants, LTD
MOTION
Upon recommendation of William Wolfson, Chief Administrative and Compliance Officer, the Board of Directors (Board) of the Great Lakes Water Authority (GLWA), authorizes the Chief Executive Officer (CEO) to enter into Contract No. GLWA-CS-213 Proposed Amendment No. 1, “Environmental Health and Safety Compliance Services” with NTH Consultants, LTD, with no increase in cost for a total cost of $2,000,000.00 and an increase in duration of 197 days for a total contract duration of 2 Years and 197 days; and authorizes the CEO to take such other action as may be necessary to accomplish the intent of this vote.
BACKGROUND
The Great Lakes Water Authority’s (GLWA) Enterprise Risk Management Safety group is committed to continuously improve environmental health and safety at GLWA and to increase environmental/occupational health and safety awareness for all GLWA employees, visitors, contractors and the communities surrounding our facilities.
This contract offers “as-needed” assistance not only for emergency environmental cleanup but also environmental compliance with local, state, and federal regulations. The vendor has and will continue to provide GLWA with:
• detailed evaluations and engineer’s estimates for remediations;
• employ experienced hazardous materials managers to coordinate and manage those cleanups;
• plan and conduct environmental assessments of known and suspected contaminated sites;
• evaluate the impact of any contaminations on GLWA facilities or operations, and advise GLWA of corrective or preventative measures to undertake;
• perform assessment of underground (USTs) and aboveground storage tanks (ASTs) for compliance with federal and state requirements. UST assessments must be performed by a Certified Professional and Qualified Underground Storage Tank Consulting firm (QUSTC). AST inspections must be performed by an API-653-certified tank inspector who is a licensed Michigan Professional Engineer; and
• perform air quality consulting services including, but not limited to operating permits and stack testing, regulatory compliance, new site installation permitting, and ambient air and worker safety air quality testing.
JUSTIFICATION
This Contract continues to provide environmental-occupational health and safety consulting including response services, waste removal and disposal, and regulatory compliance assistance on an as-needed basis. The Consultant’s response time for any emergency cleanup work shall be immediate and shall not exceed twenty-four (24) hours, depending on the size and seriousness of the incident. Under this contract the consultant has assisted in performing environmental compliance audits of various GLWA facilities, develop and audit Spill Prevention, Control, and Countermeasures (SPCC) plans, Pollution Incident Prevention (PIP) plans, Process Safety Management (PSM) plans, and Risk Management Plans (RMP). In addition, the vendor has provided the appropriate training by experienced instructors to GLWA personnel to maintain compliance with each plan’s requirements.
A new project for these services will be advertised later this year. In the interim, this Amendment No. 1 is necessary to continue these services for this contract until the new contract is awarded and commences work.
PROJECT MANAGEMENT STATUS
The proposed amendment is for time only. The total budget of $2,000,000.00 over two (2) years shows a total spend (since June 2018) of less than $600,000 (see chart below). Consequently, there is no requirement for a budget increase on this “as-needed” project due to strong management of the budget and a reduction in GLWA’s need for response services, waste removal and disposal, and regulatory compliance assistance. Beginning in fiscal year 20/21 GLWA will advertise this contract with an anticipated start date of January 1, 2021.
Original Contract Time 2 Years
Proposed Amendment No. 1 Extension for time only (197 days)
New Contract Time 2 Years and 197 days
PROJECT ESTIMATE
Original Contract Price $2,000,000.00
Proposed Amendment No. 1 $0.00
New Contract Total $2,000,000.00
FINANCIAL PLAN IMPACT
Summary: This proposed change order is for an extension of time only. The change order will extend the final completion date of this contract into FY 2021. The continued need for the services covered in this contract was anticipated when the FY 2021 budget was developed, therefore, sufficient funds are available in the FY 2021 Operations and Maintenance (O&M) financial plan for this contract.
A budget amendment will be processed to transfer the unused budget for FY 2020 to the Operations and Maintenance Unallocated Reserves.
