MOTION

 

Upon recommendation of Navid Mehram, Chief Operating Officer - Wastewater Operating Services, the Board of Directors (Board) of the Great Lakes Water Authority (GLWA), authorizes the Chief Executive Officer (CEO) to enter into Contract No. GLWA-CS-060 Proposed Change Order No. 2, “Study/Design of an Upgraded Sludge Conveyance System and Lighting Improvements at the Detroit Wastewater Treatment Plant” with Black & Veatch Limited of Michigan, for no increase in cost, for a total not to exceed $2,086,404.00 and an increased duration of 366 days for a total contract duration of 2,254 days, and authorizes the CEO to take such other action as may be necessary to accomplish the intent of this vote. 

BACKGROUND

Black & Veatch Limited of Michigan was awarded the original contract with a start work date of April 29, 2016, for a total contract fee of not-to-exceed $1,990,000.00 for a duration of 914 days. The main objective of the Black & Veatch contract was to restore sludge conveyance capacity lost due to the March 2016 fire damage and provide improved sludge conveyance from each dewatering facility to improve operations and future risks. To achieve that goal, a study, design and construction assistance from Black and Veatch was needed.

On April 14, 2018, Black & Veatch was granted a contract Change Order No. 1 of $96,404.00 for additional design and construction assistance activities, which increased the total contract value to $2,086,404.00.  The contract duration also was extended via Change Order No.1 to a final completion date of June 29, 2021, to coincide with the anticipated substantial completion of the associated construction contract (GLWA-CON-197) at Incineration Complex II at WRRF.

Construction Change Order No. 1 was issued on January 15, 2020, to Weiss GLWA-CON-197. Weiss Construction is the Constructor of the services designed by Black & Veatch under (CS-060) contract. The change order included additional work associated with the rebuild of screw conveyors 7B and 8B and reconfiguration of structural steel for the remaining screw conveyors to be installed, which extended the construction contract times to July 31, 2021 for Substantial Completion and January 31, 2022 for Final Completion.

JUSTIFICATION

GLWA requests a time extension of the current consultant services contract (CS-060) held with Black & Veatch Limited of Michigan to provide uninterrupted professional services for the remaining construction contract time associated with the GLWA-CON-197 construction project, which is ongoing within the Incineration Complex II at WRRF.

Construction Change Order No. 1 and the onset of the COVID pandemic resulted in equipment delivery delays and subsequent construction delays to the GLWA-CON-197 construction project schedule.  The project is expected to reach final completion by the end of June 2022. 

Black & Veatch and the WRRF Construction Engineering Team are in agreement to extend the final completion date of CS-060 contract from June 29, 2021 to June 30, 2022.  Black & Veatch submitted a revised time extension request and $33,440.00 cost proposal to GLWA on April 8, 2021.  The additional services cost of $33,440.00 requested by Black & Veatch in the April 8, 2021 time extension letter/cost proposal was determined reasonable and will be paid from the available provisional allowance.

The original provisionary allowance included in the contract CS-060 was $240,000.00.  The current available balance through design change directive-C as of March 31, 2021 is $117,537.00.  Any remaining unused allowance will be credited to GLWA at the end of the consultant services contract.
