MOTION
Upon recommendation of Navid Mehram, Chief Operating Officer - Wastewater Operating Services, the Board of Directors (Board) of the Great Lakes Water Authority (GLWA), authorizes the Chief Executive Officer (CEO) to enter into Contract No. 2004538/SCN-0000122, Proposed Change Order No. 2, “Instrumentation and Control System Replacement at St. Aubin, Seven Mile, and Lieb CSO Facilities” with Burns and McDonnell, at an increased cost of $390,000.00 for a total cost not to exceed $7,765,000.00 and an increase duration of 395 days for a total duration of 1,554 days and authorizes the CEO to take such other action as may be necessary to accomplish the intent of this vote.
BACKGROUND
On September 29, 2023, GLWA issued the notice to proceed with Contract No. 2004538, to Burns and McDonnell Michigan, Inc. The project is intended to upgrade the Supervisory Control and Data Acquisition systems (SCADA) at the St. Aubin, Leib and Seven Mile Combined Sewer Overflow Facilities along with select instrumentation. The project also includes upgrades to enterprise-level network equipment that will serve as the backbone for future upgrades. The original agreement required substantial completion of the project on April 26, 2024, and final completion of the project on September 29, 2024. Change Order No. 1 extended contract time, while GLWA worked to understand and negotiate changes to the substantial and final completion milestone dates. Given the difficulty of completely changing the control systems for these facilities, and the importance of maintaining facility operation while this work is occurring, there have been delays experienced by the Contractor.
JUSTIFICATION
GLWA Wastewater Engineering and the Contractor have negotiated the delays attributed to unforeseen conditions. Some delays, for example, the stopping of work by GLWA for the Contractor due to wet weather, or a sudden equipment failure, are attributable to GLWA, and constitute unforeseen conditions, resulting in delay for the Contractor. Per the Contract, the only remedy available to the Contractor for delays caused by GLWA is time. Therefore, the contract milestone and contract times to account for agreed-upon delays are modified as follows: the substantial completion date is extended from March 26, 2024, to June 29, 2025, the final completion date from September 24, 2024, to December 31, 2025, and the contract time end date from November 30, 2025, to December 31, 2026. GLWA Wastewater Engineering will continue to assess delays experienced by the Contractor as this project progresses.
Furthermore, given the unique nature of a project of this type, the initial allowance has been expended, and Wastewater Engineering is recommending an addition to the original provisional allowance to allow the project to be able to complete it successfully while managing any unforeseen conditions. The original allowance of $200,000.00 has been expended on unforeseen conditions, such as collapsed conduits requiring complete replacement, and additional network programming and hardware to convert the control systems to Ovation.
