MOTION

Upon recommendation of Navid Mehram, Chief Operating Officer - Wastewater Operating Services, the Board of Directors (Board) of the Great Lakes Water Authority (GLWA), authorizes the Chief Executive Officer (CEO) to enter into Contract No. 2203675/SCN-0000228, Proposed Change Order No. 1, “Conversion of Plumbing Shop to Satellite Warehouse Building 101” with Clark Construction Company, with no increase in cost for a total cost not to exceed $2,288,107.00 and an increased duration of 182 days for a total duration of 782 days; and authorizes the CEO to take such other action as may be necessary to accomplish the intent of this vote. 

BACKGROUND

On July 10, 2023, GLWA awarded Clark Construction Company (Clark) a Contract for the ‘Conversion of Plumbing Shop to Satellite Warehouse Building 101’ Contract No. 2203675. The Notice to Proceed was issued on July 10, 2023. The purpose of the contract is to rehabilitate the existing Plumbing Shop and surrounding area for GLWA improved storage and contractor laydown space. The contractual Substantial and Final Completion dates are December 31, 2024, and March 01, 2025, respectively.

Based on the current rate of progress, the project will not achieve either of the contract milestones. Final resolution of responsibility for the delay has yet to be determined. Currently, the project is proceeding with roofing works and all subsequent activities, such as but not limited to, siding, gutter system, internal insulation, internal Mechanical, Electrical, & Plumbing (MEP). Other outstanding work includes landscaping and final closeout.

Based on an assessment from the GLWA Project Manager, PMA Consultants, of the remaining work and the latest schedule update received from Clark, it is recommended to extend the contract time without changing the contract milestone dates for Substantial Completion and Final Completion at no additional cost to GLWA.

JUSTIFICATION

The Contract experienced several delays during the course of construction. The primary delay was due to non-compliance with contract specifications for roofing requirements resulting in delaying the roofing submittal approval and all subsequent activities such as, but not limited to, siding, roofing, gutter system, internal insulation, and internal MEP. The net schedule impact for all delays was assessed by PMA Consultants resulting in a revised contract completion. Therefore, it is recommended to extend the contract time. The Contractor chose not to sign Proposed Change Order No. 1, therefore, GLWA is issuing it unilaterally. GLWA reserves its right to assess liquidated damages subject to the schedule delay analysis. To facilitate the completion of the project while resolution of the responsibility and potential associated costs is resolved, additional contract time is required.
