RE: Proposed Amendment to Highland Park Settlement Agreement
MOTION
Upon recommendation and opinion of David Jones, General Counsel, the Board of Directors (“Board”) of the Great Lakes Water Authority (“GLWA”), authorizes the Chief Executive Officer to execute an amendment to the Highland Park Settlement Agreement; and authorizes the Chief Executive Officer to take such other action as may be necessary to accomplish the intent of this vote.
BACKGROUND
On April 7, 2025, the City of Highland Park requested an amendment of the Settlement Agreement to extend the completion date of the construction of water master meters HP-05 and HP-07 from April 26, 2025, to June 23, 2025. Highland Park now seeks to add an extension of time for the construction of the HP-06 meter from September 20, 2025, to November 15, 2025. Both the HP-05 and HP-07 meters were constructed by June 23, 2025, and are currently operational and collecting data. Pre-excavation activities have started at master meter HP-06, however construction has not begun due to several unexpected field issues. The GLWA engineering team working with Highland Park on implementing the terms of the Settlement Agreement, and the State of Michigan, also a party to the Settlement Agreement, concur with each of the Highland Park requests for an extension of the construction deadlines.
JUSTIFICATION
GLWA and the State of Michigan have tentatively agreed to the extension of the dates for installation of the new HP-05, -06, and -07 water master meters pending approval of this Honorable Body. Approval of this Amendment will provide a mutually beneficial framework for interactions between GLWA, the City of Highland Park, and the State of Michigan.
