MOTION
Upon recommendation of Navid Mehram, Chief Operating Officer - Wastewater Operating Services, the Board of Directors (Board) of the Great Lakes Water Authority (GLWA), authorizes the Chief Executive Officer (CEO) to enter into Contract No. GLWA-CON-197, Proposed Change Order No. 5, “Modifications to Incinerator Sludge Feed Systems in Complex II at WRRF” with Weiss Construction Co., LLC, at no increase in cost for a total cost not to exceed $20,386,814.00 and an increased duration of 183 days, for a total duration of 2,481 days; and authorizes the CEO to take such other action as may be necessary to accomplish the intent of this vote.
BACKGROUND
On April 2, 2018, GLWA awarded Weiss Construction Co, Inc (Weiss) ‘Construction Agreement for the Modifications to Incinerator Sludge Feed Systems in Complex II at the Water Resource Recovery Facility (WRRF) Contract No. GLWA-CON-197. The notice to proceed date was April 2, 2018. The purpose of this contract is to complete improvements to the Dewatered Sludge Cake Conveyance System (Package A), replacement of Electrical Building (EB-26) Substation (Package B), and replacement of 9 Motor Control Centers (Package C) as per the design drawings and specifications issued with the contract.
The original contract required the substantial completion date of (all packages) July 31, 2020.
The first four change orders added funds to the contract and extensions of the contract time to allow work to be completed associated with unforeseen conditions found during progression of the work. These unforeseen conditions included Covid-19 related delays as well as manufacturing delays and additional work not originally a part of the contract.
As of this Board letter, the contractor has completed rehabilitation of the sludge feed systems for all eight incinerators. The remaining work under Package A includes final modifications and performance testing of the new belt conveyors, strainers, and screw feeders, as well as completion of any owner-requested changes to the contract. Package B and C work is complete, with punch list items remaining to be completed.
The current contractual substantial and final completion dates of the contract are March 30, 2023, and July 16, 2024, respectively. Currently, correction work is ongoing to restart the previously failed 30-day performance test. Lastly, assembly of closeout documents is in progress.
JUSTIFICATION
Based on the current status of the project, the project will not achieve the final completion milestone. There have been several factors attributed to the failure of the first attempt at the 30-day performance test. A root cause analysis for the failures observed from the 30-day test has been completed and reviewed with the cause of the failure being related to several factors that engineering is working with the contractor to address and monitor more closely in this next performance test. Upon assessment of the time required to properly close the project and perform the performance test, engineering recommends a revision to the completion date to January 15, 2025. The resulting recommendation is an extension at no additional cost.
