MOTION
Upon recommendation of Navid Mehram, Chief Operating Officer - Wastewater Operating Services, the Board of Directors (Board) of the Great Lakes Water Authority (GLWA), authorizes the Chief Executive Officer (CEO) to enter into Contract No. 2002190, Proposed Change Order No. 1, “Rehabilitation of Ferric Chloride Feed System and Sludge Lines” with Weiss Construction Co., LLC, with no increase in cost for a total cost of $9,839,000.00 and an increased duration of 244 days, for a total duration of 975 days; and authorizes the CEO to take such other action as may be necessary to accomplish the intent of this vote.
BACKGROUND
On April 5, 2021, Great Lakes Water Authority issued notice to proceed to Weiss Construction Co., LLC. The project is intended to improve reliability of the ferric chloride feed system at Pump Station No. 1 and the thickened waste activated sludge (TWAS) piping between Complex B and Complex A at the Water Resource Recovery Facility (WRRF). The scope of work includes replacement of the existing ferric chloride feed system with new pumps and appurtenances, new ferric chloride storage tank and appurtenances, and modification of the TWAS pipeline at Complex B.
As of this Board letter, chemical facility rehabilitation is nearing completion with the new tank, pumps and much of the piping for the ferric chloride system installed. Significant portions of the temporary TWAS piping are complete, but the remainder of the TWAS work is delayed due to the extremely long period that has been required to obtain a Conrail permit to allow installation below the rail spur that crosses the WRRF site. Completion of this temporary TWAS piping is required so that the permanent TWAS line can be removed from service for chemical cleaning.
JUSTIFICATION
Jack and bore work required for installation of the temporary TWAS line under the Conrail spur track (across the WRRF site) was delayed due to changes in Conrail’s requirements and subsequent delays in obtaining a permit for work within the Conrail right-of-way. The Contractor’s schedule required this work to start by May 18, 2022. Eleven months in advance, the Contractor submitted a draft permit application to Conrail on June 25, 2021. On November 1, 2021, Conrail identified two revised standards that required revision of permit documents. After many resubmittals and substantial delays in review by Conrail, a permit was finally obtained on December 19, 2022. As a result of the delays, the jack and bore work will not begin until February or March of 2023.
The Contractor submitted a time impact analysis requesting a 259-day extension of the Contract Substantial Completion date due to the Conrail delays. Based on analysis of the contractor’s latest schedule submittal and updated information regarding subcontractor availability, GLWA staff and the Contractor have tentatively agreed on a 244-day time extension. This will provide time for the Contractor to complete the jack and bore work and allow all remaining work to proceed.
Given delays due to obtaining the railroad permit were not within the control of the Contractor, they are entitled to a non-compensable time extension of 244-calendar days. This 244-day time extension will apply to substantial completion and final completion.
