MOTION
Upon recommendation of Navid Mehram, Chief Operating Officer - Wastewater Operating Services, the Board of Directors (Board) of the Great Lakes Water Authority (GLWA), authorizes the Chief Executive Officer (CEO) to enter into Contract No. 1802575/SCN-0000104, Proposed Amendment No. 6 “GLWA Conveyance System Engineering Services” with Brown and Caldwell, LLC, at an increased cost of $496,920.00 for a total cost not to exceed $8,861,208.09 and an increased duration of 307 days for a total duration of 2,750 days; and authorizes the CEO to take such other action as may be necessary to accomplish the intent of this vote.
BACKGROUND
Collection System Engineering Services Contract No. 1802575 with Brown and Caldwell LLC (BC) covers engineering services for two (2) construction projects: the Connors Creek Sewer System (CCSS) Rehabilitation - GLWA Project No. 2103688, and the Woodward Sewer System (WWSS) Rehabilitation - GLWA Project No. 2004082.
The CCSS project successfully completed its scope, well under budget. GLWA Engineering, through collaboration with Operations and Maintenance, identified cost effective opportunities to enhance the CCSS system under the existing contract, including configuration to the structure where the CCSS and the Conner Creek Combined Sewer Overflow (CSO) Facility meet, as well as additional rehabilitation work to the CCSS under the Coleman A. Young Airport. This amendment will provide additional funds and a schedule extension for construction services to ensure compliance with the contract requirements.
The WWSS contract completion was delayed based on contractual issues with the original contractor. However, GLWA is in final resolution with the performance bond holder and anticipates the project completion in 2026 by another contractor under a performance bond claim. This amendment provides funds and a schedule extension for engineering and resident project representative services during construction.
JUSTIFICATION
This request for an amendment is for additional engineering scope and budget, and replenishment of a provisional allowance of $45,000.00. This will provide necessary construction administration services to support the very critical work in the CCSS under the airport runway and in the entering chamber at the Conner Creek CSO Facility to ensure compliance with the contract documents. This additional work for the CCSS was completed within the original construction services budget. However, an additional engineering budget for Brown & Caldwell is required for a greater level of support given the critical nature of the work in comparison with sewer cleaning and restoration. Additionally, in June 2024 the WWSS original construction contractor failed to complete their contractual obligation and demobilized. GLWA has brought a claim against their performance bond, requiring some additional engineering services from Brown & Caldwell to support the completion of the project and close out.
This amendment is paired with a no cost change order for Oscar Renda Contracting for CCSS, and a contract to be executed for completing WWSS.
