MOTION
Upon recommendation of Navid Mehram, Chief Operating Officer - Wastewater Operating Services, the Board of Directors (Board) of the Great Lakes Water Authority (GLWA), authorizes the Chief Executive Officer (CEO) to enter into Contract No. GLWA-CON-197/SCN-0000097, Proposed Change Order No. 6, “Modifications to Incinerator Sludge Feed Systems in Complex II at WWRF” with Weiss Construction Co., LLC with no increase in cost for a total cost not to exceed $20,386,814.00 and an increased duration of 381 days for a total duration of 2,862 days; and authorizes the CEO to take such other action as may be necessary to accomplish the intent of this vote.
BACKGROUND
On April 2, 2018, GLWA awarded Weiss Construction Co., Inc. (Weiss) Construction Agreement for the Modifications to Incinerator Sludge Feed Systems in Complex II at the Water Resource Recovery Facility (WRRF) Contract No. GLWA-CON-197. The Notice to Proceed date was April 2, 2018. The purpose of this contract is to do improvements to the Dewatered Sludge Cake Conveyance System (Package A), Replacement of Electrical Building-26 Substation (Package B), and Replacement of 9 Motor Control Center (Package C) as per the design drawings and specifications issued with the Contract.
The original Contract required the Substantial Completion date of the project (all packages) as July 31, 2020, and the original required Final Completion date of the project was January 30, 2021. As a result of the previous change orders identified below, the current contractual Substantial and Final Completion dates of the contract are March 30, 2023, and July 16, 2024, respectively.
Change Order No.1 included screw conveyor structural support steel that was relocated from above the fifth floor of incineration Complex II to a location below the fifth-floor plating. This work is completed.
Change Order No. 2 included Covid related impacts to the base contract work schedule along with additional requested modifications to the belt conveyor guard assemblies were added. The additional work is completed.
Change Order No. 3 included additional time used by the Contractor to make final corrections to provide proper functioning of the conveyors and chutes. This work is completed.
Change Order No. 4 included additional time used by the Contractor to install abrasion resistant high-density polyethylene piping and valves to serve the new strainers, in place of the previous piping which was susceptible to abrasion and frequent leakage. Additional modifications to the conveyor chutes, plows, plow tables and spray nozzles that were installed to eliminate excessive and unsustainable sludge spillage and water leakage from the conveyors. This work is completed.
Change Order No. 5 included additional time which was allocated for the Contractor to complete the remaining work under Package A, including completing final modifications to the new belt conveyors and strainers, conducting a root cause analysis of previous motor failures during initial 30-day performance test, and conducting a second 30-day performance test. This work is not completed.
The contractor began a second 30-day performance test in August 2024, but it was halted before completion due to a conveyor motor failure. GLWA, the Engineer, and the Contractor are working through the process of determining the root cause of the issues that led to the failed performance tests of the conveyor system. This Proposed Change Order No. 6 is necessary to provide contract time for Contractor to complete the root cause analysis of the system failure experienced during the second 30-day performance test, restart and complete the 30-day performance test, complete all remaining contract work, finalize closeout documentation, and close out the project. At the time of drafting this letter, the project experienced another motor failure. GLWA is engaging forensic engineering services to further the root cause analysis and drive towards determining the cause of the motor failures and ultimately determining a resolution.
JUSTIFICATION
Based on the current status of the project, it is unlikely to be completed by January 15, 2025. The Contractor was unable to successfully complete the 30-day performance test because of equipment failures and system issues. Currently, these issues are concentrated on the drum motors, and the Contractor and manufacturer have yet to identify the root cause of the motor failures. Before restarting the 30-day testing, a thorough analysis to determine why the motors continue to fail is being conducted with the assistance of a third party. The project will close out once the 30-day performance test is successfully completed, all remaining contract work is satisfactorily completed, and other contract closeout requirements are met.
