MOTION
Upon recommendation and opinion of William M. Wolfson, Deputy Chief Executive Officer/Interim General Counsel, the Board of Directors (Board) for the Great Lakes Water Authority (GLWA): (1) approves and authorizes the execution of a second lease amendment between GLWA and St. Clair County of Parcel ID 74200041004000 located in the Township of Fort Gratiot, St. Clair County, Michigan; and (2) authorizes the Chief Executive Officer to take such other action as may be necessary to accomplish the intent of this vote.
BACKGROUND
The City of Detroit, by and through the Detroit Water and Sewage Department, and St. Clair Couty entered into a lease agreement effective August 25, 2004, whereby the St. Clair County leased the property in order to operate and maintain the property as a park for a period of ten (10) years. The City of Detroit, by and through the Detroit Water and Sewage Department, and St. Clair County amended the lease on or about November 20, 2014, extending the Term for an additional ten (10) years. As a result of the Regional Water Supply System Lease, GLWA now has control and authority over the property. The current amended lease expires on December 31, 2025, and must be amended for St. Clair County to continue to operate and maintain the park on property.
JUSTIFICATION
The current lease amendment expires on December 31, 2025, and GLWA needs to amend the lease to allow St. Clair County to stay in possession of the property and operate and maintain the property as a public park. Board approval is required because it involves the lease of real property.
