MOTION
Upon recommendation of Navid Mehram, Chief Operating Officer - Wastewater Operating Services, the Board of Directors (Board) of the Great Lakes Water Authority (GLWA), authorizes the Chief Executive Officer (CEO) to enter into Contract No. 2403418/SCN-0000603, Proposed Change Order No. 1, with FH Paschen S.N. Nielson and Associates, LLC, with no increase in cost for a total cost not to exceed $3,159,000.00 for an increased duration of 169 Days for a total duration of 653 Days; and authorizes the CEO to take such other action as may be necessary to accomplish the intent of this vote.
BACKGROUND
GLWA awarded F.H. Paschen S.N. Nielson & Associates (FHP) a Construction Contract for the Emergency Baby Creek Chemical Tank Replacement Contract No. 2403418. The Notice to Proceed date was March 17, 2025. The purpose of the contract is to provide four (4) new chemical tanks and piping for the Baby Creek Screening and Disinfection Facility’s chemical feed system, demolish one old chemical storage tank, and provide new heating, ventilation, and air conditioning units. The contractual Substantial and Final Completion dates are March 17, 2026, and July 14, 2026, respectively.
The contractor encountered site specific challenges when loading the new chemical tanks for final assembly, which delayed overall progress. As a result, the project schedule was impacted, and based on the current rate of progress, the project is not likely to achieve either contract milestone by its contractual date.
Therefore, a contract time extension is necessary to ensure the project can be fully and properly closed out in accordance with contract requirements. The recommended time extension is 169 calendar days with no added cost to the project. GLWA reserves the right to assess Liquidated Damages against FHP should closeout requirements remain unsatisfied beyond the required Final Completion Date of July 14, 2026.
JUSTIFICATION
Based on the current rate of progress, the project will not achieve either of the contract milestones by their contractual date. Therefore, and to ensure that proper closeout procedure can take place within the contract time, additional time of 169 calendar days, extending the contract time, is recommended with no additional cost to GLWA.
