Investigation of the June 25th and 26th 2021 Rain Events
MOTION
Upon recommendation and opinion of Randal M. Brown, General Counsel, the Board of Directors (Board) for the Great Lakes Water Authority (GLWA):
1) Agrees to amend Contract No. GLWA-CS-2102200 with Wade Trim Associates, Inc with an increased costs of $750,000.00 for a total not to exceed amount of $1,500,000.00; and
2) Authorizes the Interim Chief Executive Officer to take such other action as may be necessary to accomplish the intent of this vote.
JUSTIFICATION
After the June 25/26, 2021 rain event, GLWA engaged Wade Trim to conduct a comprehensive review of the rain event to determine how the system operated during the event and to provide recommendations to make the system more resilient. While engaged in the work, GLWA’s service area experienced another significant rain event on July 16, 2021. As such, the scope of work was expanded to determine how the system operated during the July 16 rain event. The investigation into these rain events was extensive, requiring interviews, inspections, data review and modeling. In addition to Wade Trim’s effort, the Board retained AECOM to investigate the rain events as well. The Board took further action to have the parties collaborate, to the extent possible, on the rain events findings.
Even with the close of the investigation in the near future, Wade Trim’s services will be necessary as an expert in the pending litigation of which more than a dozen lawsuits have been filed. Continuing with Wade Trim’s services as an expert in the litigation promotes efficiencies in defending the pending actions.
BUDGET IMPACT
Sufficient funds are available in the Office of the General Counsel’s budget for the rain event litigation, and a portion of the Wade Trim’s fees may be covered by GLWA’s insurance providers.
COMMITTEE REVIEW
This matter was presented to the Legal Committee at its meeting on June 22, 2022. The Legal Committee unanimously recommended that the GLWA Board adopt the resolution as presented.

This request does not impact the Shared Services Agreement.
