MOTION
Upon recommendation of Navid Mehram, Chief Operating Officer - Wastewater Operating Services, the Board of Directors (Board) of the Great Lakes Water Authority (GLWA), authorizes the Chief Executive Officer (CEO) to enter into Contract No. 2003330, Proposed Change Order No. 2, “HVAC and Odor Control Improvements, Oakwood CSO” with Commercial Contracting Corporation, with no increase in cost for a total cost not to exceed $5,992,000.00 and an increased duration of 183 days for a total duration of 1,015 days; and authorizes the CEO to take such other action as may be necessary to accomplish the intent of this vote.
BACKGROUND
The Oakwood HVAC project includes many improvements to the Oakwood HVAC system for the sanitary pump station and electrical rooms at the Oakwood CSO Facility. The first change order was issued in September of 2022 extending the contract for the completion of additional scope of work from a failed air handling unit in the electrical room. The extension allowed additional time to provide and startup a new air handling unit as well as time to ensure all other remaining items of the contract were completed.
As of September 30, 2023, the Contractor has not met final or substantial completion requirements. GLWA project management has been working with the Contractor to resolve the outstanding items related to the new air handling unit and the vibration sensors for the exhaust fans on the basin.
JUSTIFICATION
To meet GLWA Contractual requirements of being on site, the contract must be updated with a new end date of the contract which governs performance of the work, but not the completion of the work. Currently, GLWA project management is assessing whether liquidated damages against the Contractor will become necessary.
The contract closeout change order will establish the final value of the contract which will subtract liquidated damages assessed, if any, against the final value of the contract.
